That said, since anyone who owns or operates a motor vehicle in the province is required to carry automobile insurance, injured car accident survivors may be able to receive some financial support through Section B benefits. Included in all Standard Owners’ Policies, Section B benefits can often be used to cover the costs of necessary injury-related expenses. In fact, for up to a maximum of four years following the accident, car accident survivors could receive up to $50,000 in financial compensation for damages they have incurred. These damages commonly include:

  • Medical expenses
  • Ambulance bills
  • Medical equipment
  • Prescriptions
  • Mobility aids
  • Physiotherapy
  • Chiropractic sessions
  • Massage therapy
  • Strength-training exercise programs
  • Psychological counselling
  • Home modifications to accommodate acquired disabilities
  • Mileage expenses for trips to and from medical appointments
  • And possibly more

Also known as no-fault accident benefits, Section B benefits may be made available to any injured car accident survivor, regardless of their level of culpability for the collision. That means that, even if mistakes you made behind the wheel of your car contributed to the causes of your accident, you may still be entitled to receive Section B benefits.

The injuries sustained in a car crash may adversely affect an accident survivor’s ability to perform their jobs. When injuries resulting from motor vehicle collisions make it impossible for an injured accident survivor to return to work, Section B benefits could provide income replacement payments for up to two years following their collision. These Weekly Indemnity Benefits can replace 80% of an injured worker’s earnings, up to a maximum of $250 per week.

If an injured accident survivor cannot continue maintaining their residence as a result of their injuries, insurance policies may also cover the costs of housekeeping services by providing them with $100 per week for 52 weeks in order to retain the services of a housekeeper.

Additionally, if an automobile collision ends in wrongful deaths, insurance policies could provide bereaved family members with up to $2,500 for funeral expenses. Up to $25,000 in death benefits may also be available for the head of the household or their spouse; the deceased’s dependents may also be able to receive up to $5,000 in benefits payments.

In the wake of an injurious car accident, unexpected expenses can accumulate quickly. Section B benefits provide much-needed financial support to eligible insurance policyholders to help them navigate their challenging circumstances. Unfortunately, though, for a number of different reasons, insurance providers often deny claims for Section B benefits, even if a policyholder in good standing was severely injured in a collision.
