Also referred to as “no-fault accident benefits,” Section B benefits should be made available to any automobile insurance policyholder who was injured in a motor vehicle collision, even if their own negligence behind the wheel caused that collision to occur. No matter who was at-fault for the accident, if they were injured as a result, for up to four years following the date of their collision, policyholders could be able to collect a maximum of $50,000 in Section B benefits to offset the costs of certain newly acquired expenses. These expenses often include:

  • Medical equipment
  • Prescriptions
  • Mobility aids
  • Physiotherapy
  • Chiropractic sessions
  • Massage therapy
  • Strength-training exercise programs
  • Psychological counselling
  • Home modifications to accommodate acquired disabilities
  • Mileage expenses for trips to and from medical appointments
  • And possibly more

Furthermore, depending on the impact their injuries have had on an accident victim’s overall quality of life, injured car crash survivors may be entitled to additional coverage. For example, if an injured motorist is unable to continue working because of the injuries they acquired in their collision, they may be able to recover income replacement payments. For up to two years, these weekly indemnity benefits can provide injured accident survivors with a maximum of $250 per week.

For injured car crash survivors who are no longer able to perform routine work around the house and have no one in their household to provide assistance, for up to 52 weeks, Section B benefits can provide a maximum of $100 per week  in order to hire a housekeeper. Furthermore, in the truly unfortunate circumstances where motor vehicle collisions end in fatalities, families of the deceased may receive $2,500 for funeral expenses, $25,000 in death benefits for the head of household or their spouse, and $5,000 in death benefits for dependents.

Section B benefits provide much-needed financial assistance to injured insurance policyholders who, because of an unexpected collision, need to avail themselves of the coverage to which they should be entitled. However, for a number of reasons, insurers often deny claims for Section B benefits, even from policyholders who have provided extensive medical evidence proving the severity of the injuries they sustained in an accident.
